You acknowledge that ARYSE Health's services, as described in our Privacy Notice, depend on your informed and voluntary participation. You also agree that the accuracy, completeness, reliability and clinical usefulness of the services depend on:

• Your voluntary, affirmative and explicit consent, where required; and

• The completeness, accuracy and scope of the personal data, medical history, biological samples, biometric inputs and other information you choose to provide, as described in the Privacy Notice.

Your participation in any test, diagnostic procedure, laboratory investigation, wearable or device integration, consultation recording, monitoring programme, follow-up assessment or related service is entirely voluntary.

If you:

1. Decline or omit to provide any biological or other sample required for a diagnostic, clinical or confirmatory test;

2. Choose not to undergo, or choose to stop, any diagnostic assessment or procedure, such as body composition scanning, VO2 Max testing, movement analysis, blood biomarker panels, genomic testing or imaging;

3. Refuse, stop or fail to enrol in or complete any recommended test, investigation or service;

4. Decline to connect authorised health devices or monitoring tools; or

5. Withhold, omit or give incomplete or inaccurate health information, medical history, symptoms, lifestyle details, genetic material, biological samples, biometric data or other relevant personal data, you acknowledge and agree that our ability to identify, assess, monitor, interpret or address your health conditions, symptoms, risk factors, deficiencies, predispositions, health needs or changes in health status, or to give you insights or recommendations about them, may be materially limited or incomplete.
   
   

You further acknowledge that without full participation, data or testing, some health conditions, clinical findings or abnormalities may go undetected, unverified or misinterpreted, and that any resulting report, analysis, clinical conclusion or recommendation may be incomplete, inconclusive or of limited clinical value.

Accordingly, to the maximum extent permitted by applicable law, ARYSE Health is not liable for any error, omission, limitation or inadequacy in detecting, identifying, assessing, monitoring, interpreting or communicating any health condition, symptom, risk factor, abnormality or clinical conclusion. This applies whether it arises directly or indirectly from your refusal, withdrawal of consent, non-participation, or failure to give complete and accurate information or samples.

By choosing not to participate fully, or by withholding or withdrawing consent, samples or information, you voluntarily accept all risks of any such limitation or inadequacy. You waive any claim against ARYSE Health that arises solely from that refusal, withdrawal, omission or non-participation. Nothing in this clause excludes or limits liability to the extent that such exclusion or limitation is prohibited by applicable law.
